In a recent email alert, the National Customs Brokers & Forwarders Association of America (NCBFAA) raised concerns about U.S. Customs and Border Protection (CBP) accepting duty calculations for new import duties on Chinese goods without proper verification.
The NCBFAA urged customs brokers to take two key actions: first, ensure that the correct duty is being paid to CBP, and second, be aware of the 10% duty rate under Harmonized Tariff Schedule subheading 9903.01.20.
Additionally, the NCBFAA pointed out several limitations in the Automated Commercial Environment (ACE) system, including that it does not verify duty calculations when a line includes more than two HTS codes. They also highlighted that CBP does not validate the export date against the correct HTS codes (9903.01.20 or 9903.01.23). It is recommended to closely review the HTS codes used based on the export date
